During a recent appearance on CNN’s “The Source,” Hunter Biden’s attorney, Abbe Lowell, discussed the appointment of David Weiss as a special counsel and its implications. Lowell pointed out that Weiss’s status as a special counsel doesn’t grant him any additional power than he already had. Both Attorney General Merrick Garland and Weiss himself had emphasized that he possessed the authority to bring appropriate charges at the right time and place even before his appointment as special counsel. Lowell clarified that the practical effect of this appointment is minimal.

Lowell elaborated that the change in title to special counsel does not alter the situation significantly. He emphasized that the power and authority Weiss possesses now are essentially the same as before. Lowell questioned the significance of the change, considering that Weiss already had the necessary authority. He reiterated that the special counsel’s role doesn’t fundamentally change the scenario.

Addressing the potential impact of Weiss’s appointment on Hunter Biden’s case, Lowell expressed confidence that if the prosecuting office adheres to the facts and the law, the outcome should remain consistent with their previous position.

Regarding the failed plea bargain, Lowell explained that the disagreement stemmed from differing interpretations of the plea deal. He posed a rhetorical question about the rationale behind a client pleading guilty to a misdemeanor on Monday if prosecutors could potentially bring a felony charge on Wednesday. He suggested various possibilities for the confusion, including miscommunication between the parties or prosecutors making statements that were either inaccurate or vague. He also noted that the prosecutors seemed to change their stance as the proceedings unfolded in court.
