After May 11, when Title 42 expires, tens of thousands of people are expected to cross the southern border illegally.
According to Fox News, the Biden administration is sending 1,500 active-duty U.S. troops to the southern border in the coming days out of concern that tens of thousands of migrants may flood into the nation if Title 42 is abolished.
According to two senior American officials briefed on the negotiations, the United States will deploy active-duty soldiers from different Army units to perform a range of administrative and transport duties for a period of 90 days. It’ll free up some resources for the police and the Border Patrol.
National Security Council spokesperson John Kirby said that current border assistance operations dating back to George W. Bush’s presidency are in line with the 90-day modification. The Pentagon claims that DHS requested the troops, and that their deployment may begin as early as May 10.
There have been signals from the government that they would follow former President Trump’s example and send troops to the border. The military would have weapons only for self-defense and would have no role in maintaining law and order.
A statement provided by Pentagon spokesman Brig. Gen. Pat Ryder said, “for 90 days, these 1,500 military personnel will fill critical capability gaps, such as ground-based detection and monitoring, data entry, and warehouse support, until CBP can meet these needs through contracted support.” The directive states, in relevant part, that “military personnel will not take part in patrolling duties.” Border security is something the military has been aiding DHS with for some time.
CBP has warned that illegal entry into the country “will result in removal.” The Biden administration has strongly suggested that anyone seeking asylum use the CBP One app to set up interviews in advance.
There is a discrepancy between the Biden administration’s rhetoric and its actions on immigration. A considerable number of illegal immigrants have been immediately repatriated as a response to the COVID-19 outbreak, thanks to the Title 42 order enabling for speedy deportation of migrants at the border. Despite the order, not all illegal immigrants have been deported.
According to Title 42, only around 46% of illegal immigrants who were captured at the border were actually deported. Secretary of Homeland Security Alejandro Mayorkas told legislators last month that around 360,000 of the almost 1.3 million aliens who went through Title 8 in FY 2022 were deported.
At the border, the White House said Tuesday that sending soldiers “would not be necessary if Congress would act.”

Illegal immigrants who have not made an appointment through the CBP One app and who have not previously claimed asylum in a country they passed through are not eligible to receive asylum in the United States, according to a new rule issued by the Biden administration regarding asylum claims before Title 42 expired.
Mayorkas has made it clear that there are circumstances in which the “presumption of ineligibility” can be rebutted. Democrats and immigration groups are upset because it sounds like the Trump administration’s travel ban and would prevent anyone from any nation from seeking asylum in the United States.

The administration is working more closely with Mexican authorities and non-profit groups to establish alternate Title 8 removal mechanisms in light of the expected huge number of arrivals.
CBP agents will reportedly begin conducting “credible fear” interviews with asylum seekers at checkpoints, as reported by Fox News Digital earlier this month. The asylum application process begins with this step. In a statement, DHS said it is working with nonprofit legal aid groups “to give people who go through credible fear interviews while in CBP custody access to legal services.”
