    Neely Family Prepares Wrongful Death Lawsuit Against ‘Subway Vigilante’

    In the aftermath of a heart-wrenching incident aboard the F train, the family of a homeless man who tragically lost his life is preparing to seek justice through legal means. According to information obtained by The Post, they intend to file a wrongful death lawsuit against Daniel Penny, the individual responsible for placing the man in a fatal chokehold. The incident, captured on film and widely circulated online, has sparked a wave of outrage and a call for accountability.

    In an exclusive interview with The Post, Daniel Penny, who currently faces manslaughter charges, vehemently denied any racial motivation behind his actions. He expressed deep remorse over the system’s failure to adequately support the victim, Jordan Neely, who was known to be mentally ill.

    Carolyn Neely, Jordan’s aunt and the representative of his estate, has retained the services of the esteemed Manhattan law firm Mills & Edwards, as revealed in a letter acquired by The Post. The letter, serving as a stern warning, notifies Penny’s lawyers of their intent to pursue a civil case for personal injuries and wrongful death. It explicitly states that Penny’s actions directly led to the untimely demise of Jordan Neely. Additionally, the letter requests Penny’s insurance details, indicating the family’s determination to seek justice and compensation for their loss.

    Steven Raiser and Thomas Kenniff, attorneys representing Daniel Penny, declined to comment on the matter, allowing the legal proceedings to unfold in due course.

    Despite having posted bail and regained his freedom, Penny finds himself in a precarious situation. However, an astonishing turn of events has emerged in the form of an overwhelming show of support. His legal defense fund has amassed a staggering $2.8 million in donations, reflecting the solidarity of people from various walks of life. The campaign, initiated by Penny’s lawyers on the GiveSendGo platform, has garnered contributions to aid in his defense. Notably, the lawyers have pledged that any remaining funds, after covering legal fees, will be donated to a New York City mental health organization, recognizing the broader societal issues at stake.

    Eyewitnesses confirmed that the recorded footage captured Penny restraining Neely in a chokehold, assisted by two fellow passengers. Neely’s erratic behavior and threats towards other commuters provided context to the unfolding events. Neely’s troubled history of mental illness and previous encounters with the law further complicate the circumstances surrounding this tragedy.

    In his interview with The Post, Penny expressed deep sadness over the loss of life, acknowledging the profound failure of the system to adequately address the needs of individuals like Neely. He voiced hope that through collective efforts, the flaws in the system can be exposed and rectified, ensuring that similar tragedies are prevented in the future. The quest for justice continues as the family prepares to navigate the legal process, seeking solace and closure in their pursuit of accountability.
