In an interview with Fox News Digital, famous immigration expert Hans von Spakovsky said that Mayorkas had likely been breaking federal immigration law.

According to an exclusive report on Fox News Digital, Homeland Security Secretary Alejandro Mayorkas should be impeached for lying.

At the same time that Republican lawmakers in Washington, DC were crafting articles of impeachment and probing the mayor’s handling of the country’s borders, the Heritage Foundation, a renowned conservative think tank, produced a critical appraisal of Mayorkas’ stint in office.

In their recent analysis, Lora Ries, Steven Bradbury, and Hans von Spakovsky express concern that similar legislation would be implemented.

“[Mayorkas] has broken his oath of office, misused the powers of his position, and betrayed the confidence of the American people,” the study says of the former homeland security secretary’s tenure in that role. Because of him, America is seeing a “catastrophic breakdown” in border security, national defense, and illegal immigration.

In light of these offenses, the research recommends that Secretary Mayorkas be impeached, removed from office, and declared unfit to hold any other position of honor, trust, or profit under the United States.

No cabinet secretary has been removed from office due to impeachment in over a century. On the other hand, Heritage thinks that Mayorkas should be excused this time since he is:

He has openly promoted illegal immigration over the United States’ southern border, for example, showing a blatant disregard for and defiance of the same laws he is sworn to uphold.
To intentionally mislead the situation at the border to the American people and their lawmakers is a serious violation of trust on the part of government workers.

Von Spakovsky responded to Fox News Digital’s inquiry by saying no cabinet member in charge of a vital department has ever claimed, “I may waive requirements of the law and urge my people to disregard the laws they are expected to follow.” The choice Mayorkas made was the worst one ever made by a cabinet minister. The conduct may warrant impeachment proceedings.

This study sheds light on the dire circumstances along the southern U.S. border. A record number of illegal immigrants have crossed the southern border since Mayorkas became DHS secretary (DHS). The number of illegal immigrants who entered the United States in December was a record 251,488, according to CBP statistics. This is the highest it has ever been for the fiscal year that ends on September 30, 2022. Over the past 10 months, over 200 thousand incidents involving migrants have been reported.

Nonetheless, “he doesn’t think someone should be forbidden access,” as von Spakovsky puts it, despite what Mayorkas may say. It is the narrator’s “obligation,” he says, to break U.S. immigration law and hire as many illegal workers as possible.

In May, Bret Baier of Fox News posed the question to Mayorkas: “Is it the aim of the Biden administration to diminish, substantially lessen the overall number of illegal immigrants flooding across the southern border?”

When asked about the administration’s priorities, Mayorkas said the Biden team was striving to provide “fair, efficient, and authentic access to the legal system for all Americans.”

Federal law states that parole for migrants seeking entry into the United States should be granted temporarily and “only on a case-by-case basis for urgent humanitarian reasons or significant public benefit,” but the Heritage report details how Mayorkas has “violated” the law by directing DHS to “mass-parole” illegal immigrants into the country.

Ries told Fox News Digital in an interview that Mayorkas “refers to most folks as asylum seekers,” but he has evidence that “most persons here aren’t qualifying refugee applicants.” His lobbying will convince those who need asylum the most, leading them to enter the country illegally.

To gain asylum in the United States, asylum seekers must prove that they are persecuted or fear being persecuted in their home country due to their race, religion, nationality, membership in a social group, or political opinion. According to Heritage’s writers, millions of economic migrants who may be escaping poverty but who do not fit the criteria for asylum are open to systematic exploitation because of Mayorkas’ statements and actions.

Due to a backlog, the asylum process in U.S. immigration courts might take years.

Security gaps have been reported throughout the entire 1,954-mile U.S.-Mexico border, according to former high-ranking border patrol agents.

Since this poses a threat to national security and humanitarian disasters, Heritage has issued a warning.

At least 1.2 million illegal immigrants are thought to have “escaped” to other nations when Mayorkas was in command of the border patrol. There were 98 persons on the Terrorist Screening Dataset with whom Border Patrol agents had contact outside of the regular ports of entry in FY2022. There have been 38 so far in the first three months of the fiscal year 2023. In FY2020 there were just three, while in FY2021 there were only sixteen.

An in-depth discussion of how Mexican drug and human trafficking gangs have leveraged the present situation at the border to expand their activities inside the United States, with young adults as their primary targets, Heritage goes beyond the scope of a typical discourse about border security.

Media attention was extensive for the alleged rape and murder of a 20-year-old autistic woman by an undocumented immigrant last month.

The same consequence is achieved by Mayorkas’ unlawful measures, Heritage has concluded.

Because he “has violated conventions, disregarded laws, lied, placed his officers and employees in substantial jeopardy,” Ries says that the president should be impeached. Because of him, the security of the nation, the people, and the public is at risk. And so has the faith of the American people in him.

Mayorkas is accused of “betrayal of the public confidence” in a large portion of the report, in which he is said to have repeatedly assured Congress and the public that the border was safe despite the persistent problem.

Past inquiries also found that Mayorkas fabricated or concealed evidence. The DHS director in 2021 made up a story about lashing Haitian migrants by mounted U.S. border patrol personnel.

Ries claims that the administration “came up with this phony story” to muzzle dissenting voices. Mayorkas still holds to his word, even after all these years. Sadly, several members of the team were killed.

The Digital News division of Fox News reached out to DHS for comment.

Advocating for the “good cause,” “supporting its fantastic personnel,” and “serving the American people” at the Department of Homeland Security (DHS) brings me great joy (Fox News Digital). For the Department to realize its mission of “constructing a safe, orderly, and humane immigration system,” it must maintain its focus on law enforcement and border security.

The Department of Homeland Security referred Fox Press Digital to a press release praising the decrease in unlawful crossings between ports of entry after Vice President Joe Biden announced “increased border enforcement operations to combat illegal immigration” last month.

Since Border Patrol personnel were moved from their previous roles of the port-to-port patrol to their new jobs of port-to-port work, Ries claims the changes amounted to more of a “shell game” than an actual reduction in staff.

There has been speculation that the articles of impeachment against Mayorkas don’t allege sufficiently serious wrongdoing to justify his removal from office following the Constitution.

The 60 votes are necessary to impeach Trump do not exist, and not even among Republicans who favor the idea. To draw attention to the administration’s “alleged inadequacies” in safeguarding the southern border, distinguished constitutional law professor Alan Dershowitz submitted an opinion article for the New York Daily News over the weekend. “may have enough Republican votes to satisfy their illicit political aim,” the study says, even though many moderate Republicans don’t appear prepared to follow through with this lie. It’s not only liberals and conservatives who have taken advantage of the impeachment process to further their causes; both sides have done it.

In response to these allegations, von Spakovsky said emphatically that he had not singled out Mayorkas for prosecution because of the latter’s politics.

He then argued that disagreements over policy were only “political” and not grounds for impeachment. If a public official is found guilty of violating the law, they may face impeachment. Mayorkas’s flagrant disregard for immigration law is criminal and calls for a just response.

I argued that “They may claim it’s political,” and he acknowledged that I had a point. On the other hand, I believe we have a very solid argument. Mayorkas must uphold the law regardless of whether or not he supports it.

It is concluded that “behaving in a manner incompatible with the lawful powers and purpose of the office” is one of the constitutional bases for impeachment in this article.

Heritage felt compelled to release its findings as Republicans in the Assembly introduced a second impeachment resolution against Mayorkas this week.

At least one Heritage contributor is worried that Mayorkas’s defeat may be tied to the Republican Party’s retreat on border security now that the midterms are over.

Ries gave the following reason for impeaching Mayorkas in an interview with Fox News Digital: The writers explain, “We wanted to underline why this is legitimate for Mayorkas to be impeached—to remind people of the falsehoods he’s uttered, the laws he’s violated, and the damage he’s done to the country and will continue to do if he keeps continuing.”
