Supreme Court Stops Trump’s Use of Wartime Law to Deport Venezuelan Migrants

The U.S. Supreme Court has issued an emergency order halting the Trump administration’s use of the centuries-old Alien Enemies Act to deport Venezuelan migrants, citing concerns over due process violations and lack of legal transparency.

The decision comes amid reports that detainees were being removed without adequate notice or the opportunity to challenge the allegations against them. The administration had invoked the 1798 law to target individuals it claimed were affiliated with the Venezuelan criminal group Tren de Aragua.

However, legal advocates pushed back, arguing that many of those swept up in the operation were not given sufficient time or information to defend themselves, raising alarms about constitutional rights and judicial oversight.

This ruling follows a pattern of escalating legal challenges, particularly after over 130 Venezuelans were deported in March despite a federal judge’s restraining order. Those deported were transferred to El Salvador’s high-security CECOT facility.

While the administration insists its actions are justified on national security grounds, critics say the use of such an antiquated wartime law bypasses modern standards for civil liberties.

The Supreme Court’s move signals a broader legal battle over the scope of executive authority in immigration enforcement. The temporary block will remain in place as further arguments are reviewed, leaving the future of the affected migrants in legal limbo.
