Alito Torches Supreme Court for “Unprecedented” Midnight Block on Trump Deportations

Justice Samuel Alito issued a scathing rebuke following the Supreme Court’s emergency order to temporarily block the deportation of Venezuelan migrants targeted under the Alien Enemies Act, calling the decision legally unsound and procedurally unprecedented.

The emergency action paused the Trump administration’s plan to remove individuals suspected of ties to the Venezuelan gang Tren de Aragua. The administration had invoked a centuries-old wartime statute to justify the removals, arguing that the threat posed by certain migrants warranted swift action.

In his dissent, Alito sharply criticized the Court’s majority for intervening without a full legal review or input from lower courts, warning that such an abrupt move undermines judicial norms. He noted the absence of detailed reasoning and described the Court’s response as lacking transparency and a proper factual foundation.

Supporters of the pause argue the deportations circumvented due process, with reports suggesting that migrants were removed without sufficient notice or legal recourse. The Supreme Court’s order temporarily suspends those removals while further litigation continues.

The legal clash highlights growing tension between executive immigration authority and the judiciary’s role in safeguarding constitutional protections, setting the stage for an intense battle over the limits of emergency powers and the rights of non-citizens facing removal.
