    Judge Says Pet Dogs Deserve Legal Recognition as Family

    A Brooklyn judge has made a groundbreaking legal ruling by classifying dogs as “immediate family” in a recent emotional distress lawsuit. The case involves Duke, a beloved four-year-old dachshund struck and killed by a driver who ran a stop sign on July 4, 2023.

    Nan DeBlase was walking Duke on a leash when the driver hit the dog, narrowly missing her. Witnessing the traumatic event, she has been granted the rare right to pursue damages for emotional injury under the legal “zone of danger” doctrine—typically reserved for close relatives present during human tragedies.

    Judge Aaron Maslow emphasized that pets—especially dogs walked on leashes—are deeply woven into family life and deserve recognition under the law. He clarified that her son, Trevor, could not claim emotional damages since he was not at the scene, preserving the ruling’s limited legal scope.
