    A Trump-aligned legal organization has petitioned top federal health agencies to roll back a regulatory policy introduced under the Biden administration, arguing the rule shifts kidney transplant priority from medical need to demographic factors. The group claims the regulation hinges on a “diversity, equity and inclusion” framework rather than strictly medical criteria.

    The petition outlines how the rule impacts hospitals participating in the IOTA transplant model, stating that dozens remain obligated to maintain DEI mandates while carrying out organ allocation. The legal group intends a full repeal, asserting the policy conflicts with federal law by introducing race- and identity-based preferences into life-sustaining medical decisions.

    Agency officials now face potential rulemaking or formal reconsideration as part of the legal challenge, signaling renewed scrutiny of whether race-conscious public-health regulations align with the nation’s non-discrimination obligations.
