    Driver Accused in Gaudreau Brothers’ Death Hit Legal Roadblock

    An alleged drunk driver who reportedly killed NHL player Johnny Gaudreau and his brother Matthew while they biked on a New Jersey roadway has suffered a major setback in his case.

    Defendant Sean Higgins, 44, had sought to suppress key statements he made to police—including an admission that he had consumed “five or six drinks” and the remark “I hit them, I hit them”—arguing his rights were violated. A judge rejected that motion, finding he was not under arrest during initial questioning and that his rights were properly read at the station.

    Higgins faces multiple charges including vehicular homicide, aggravated manslaughter, evidence tampering, and leaving the scene of an accident. The crash occurred on Aug. 29, 2024, when the Gaudreau brothers, riding their bikes ahead of their sister’s wedding, were struck from behind after Higgins allegedly attempted an illegal pass.

    The judge’s decision means the prosecution may proceed with the evidence intact and the case remains headed toward trial.
