Abbe Lowell, attorney for Hunter Biden, has notified the House Judiciary and Oversight Committees of his client’s willingness to comply with a newly issued subpoena for a hearing or deposition, provided that it is issued in the course of a lawfully authorized impeachment investigation involving President Biden. This progression occurs subsequent to the committees’ recommendation to hold Hunter Biden in contempt of Congress for failing to comply with previous subpoenas that requested his closed-door deposition testimony.

Lowell had earlier raised concerns regarding the legality of the initial subpoenas, contending that they were issued prematurely and in the absence of a formal authorization vote by the entire House of Representatives to initiate the impeachment investigation. He expressed that adherence would be forthcoming in the form of a novel subpoena that adheres to appropriate procedural principles.

Tuesday is the scheduled date for the House Rules Committee to meet in order to deliberate on a resolution pertaining to Hunter Biden’s contempt of Congress. After the committee concludes its deliberations, the resolution will proceed to a comprehensive House vote in order to ascertain the prosecution recommendation.

Lowell, in his correspondence with the committees, put forth a hybrid framework for a public deposition wherein Republican and Democratic members would conduct alternating sessions of questioning. By means of this proposal, an open and fair interrogation procedure is intended to be established.

In light of Hunter Biden’s public statements and initial opposition to the subpoena issued outside the Capitol, the congressional investigation has witnessed a shift in the strategy employed by his legal team, as evidenced by their agreement to comply with the reissued subpoena. James Comer, chairman of the House Oversight Committee, and Jim Jordan, chairman of the Judiciary Committee, had previously denied Hunter Biden’s request for public testimony, emphasizing the importance of treating all witnesses consistently.

In regard to Hunter Biden’s actions, the White House has consistently adopted a position of non-interference, emphasizing his private citizen status and the independence he exercises when addressing congressional inquiries. In the interim, the inquiry into the possible complicity of President Biden in his son’s defiance of the subpoena persists, giving rise to concerns regarding the potential impeachment of such conduct.
