On Wednesday, legal representatives for former President Trump faced a setback as their request for a direct and immediate decision in the Trump Organization’s ongoing civil case was turned down, following ex-lawyer Michael Cohen’s testimony.
Cohen, during his time on the witness stand, conceded that the former president never instructed him to manipulate his financial details on a personal financial statement. The ex-president, now a leading figure in the 2024 Republican presidential race, and his previous legal advisor were once again in the same courtroom, marking their second consecutive day in the trial. This trial originates from a comprehensive inquiry by New York Attorney General Letitia James into both the Trump Organization and the Trump family’s business dealings.
On his second day testifying, Cohen, once a close associate and attorney for Trump, famously noted for his declaration that he would “take a bullet” for Trump, was explicitly questioned if Trump had ever directed him to exaggerate his financial situation on personal financial documents. To this, Cohen responded affirmatively.
Subsequent to Cohen’s reply, Clifford Roberts, Trump’s lawyer, conferred with the ex-president and other defense attorneys before informing Judge Arthur Engoron that he had no additional questions. Roberts then proceeded to request a direct and immediate decision in the case, given Cohen’s testimony.
However, Judge Engoron promptly rejected the request, stating, “Denied.”
The trial has its roots in a lawsuit filed by Attorney General James, accusing Trump and his organization of misleading banks and other entities regarding the value of his assets. James has argued that the Trump family, alongside their associates and businesses, have been involved in “numerous acts of fraud and misrepresentation” on their financial documents. She further alleges that Trump significantly overstated his net worth, claiming it was inflated by billions, and accuses his children of aiding him in this deception.
Despite these allegations, Trump has consistently maintained his innocence, insisting that his assets have actually been undervalued, and emphasizing that his financial statements included disclaimers urging banks to verify the numbers themselves.
Cohen clarified during his testimony that although Trump did not explicitly instruct him to inflate the numbers, he communicated in a way that made his expectations clear, comparing Trump’s communication style to that of a “mob boss.”
Engoron, who presides over the non-jury trial, had previously ruled last month that Trump and his organization had committed fraud during the construction of his real estate empire, by misleading banks, insurance companies, and others through inflated asset valuations and exaggerated net worth claims on official documents.
Following Cohen’s testimony, the defense lawyers did not cross-examine him further and instead repeated their request for a verdict. Engoron, once again, swiftly denied the request, emphasizing the absurdity of expecting a verdict based on one witness’s testimony and assuring that there was ample evidence to proceed with the trial.
Engoron also called upon Trump to testify on Wednesday, addressing previous statements Trump had made to the media about partiality in the courtroom. Trump clarified he was referring to Engoron and Cohen, leading Engoron to issue a partial gag order after discovering a post on Trump’s campaign website that he deemed violative of the gag order.
Despite the tension in the courtroom, the civil trial is set to resume on Thursday. The outcome of this legal face-off between Trump and Cohen remains highly anticipated, especially given their previous legal battles and Trump’s recent dismissal of a lawsuit against Cohen, with a promise to refile after overcoming what he terms as “witch hunts” against him.
Simultaneously, outside the courtroom, Trump took a moment to comment on the House speaker race, expressing his support and congratulations to Rep. Mike Johnson for his election, highlighting Johnson’s leadership qualities, and thanking his supporters.
