Representative LaMonica McIver (D–NJ) has been indicted on three federal charges, including two counts of impeding federal officers and one misdemeanor, following a heated confrontation during an ICE oversight visit at the Delaney Hall immigration center in Newark on May 9. According to authorities, McIver physically interfered with agents attempting to arrest Mayor Ras Baraka, allegedly using her forearms to strike and restrain officers. Should she be convicted, McIver could face up to 17 years in prison.
The charges, announced by U.S. Attorney Alina Habba, mark a rare case of a sitting member of Congress facing prosecution for actions outside of fraud or corruption. McIver has strongly denied wrongdoing, describing the indictment as politically motivated and asserting she was performing her congressional responsibilities. An arraignment is expected within weeks, and McIver has pledged to enter a not-guilty plea and fight the charges.
The incident drew national attention, sparking debate over immigration enforcement, congressional oversight powers, and the rare legal action against an active lawmaker.
