Kennedy, Jr. has raised concerns over the Colorado Supreme Court’s recent decision to bar former President Donald Trump from the 2024 ballot. The court’s decision, linked to Trump’s involvement in the January 2021 Capitol incident, stirred a debate on democratic principles and voter rights.
Kennedy, who switched from a Democratic primary challenge to an independent run, emphasized on social media the risks of alienating voters and the potential for civil unrest if judicial interventions replace electoral processes. “The core of democracy is trust in the electorate’s choice, not in judicial mandates,” he expressed, urging a return to the foundational values of voter sovereignty.
He criticized the Colorado court’s 4-3 ruling under the 14th Amendment insurrection clause, suggesting it undermines the fundamental democratic right to choose one’s leaders and could fuel public mistrust towards the legal system’s impartiality. Kennedy called for due process and the right to confront accusers, noting the absence of a criminal conviction against Trump in the context of this decision.
