After hearing Thomas’s outspoken criticism of the Biden administration’s planned modifications to Title IX, former All-American swimmer Riley Gaines lashed out at the trans athlete.

An outright ban on transgender athletes would be in violation of Title IX, the 80-year-old Democrat Biden said.

Even with federal funding, schools can restrict transgender kids’ access to some activities, such as high school and college sports, if they so choose.

Thomas, a former member of the University of Pennsylvania women’s swim team who identifies as transgender, released a video on Instagram on Monday in which she expressed partial support for the new rule but claimed it fell short.

To begin with, this rule is helpful. However, that is not sufficient. Thomas argued that trans people need “explicit protection from discrimination” in the face of growing anti-trans sentiment in order to “live our lives freely and equally.”

Her issue is that transgender students may still face discrimination in high school and college “under the guise of competitive fairness,” despite the rule’s intent.

She went on to say that swimming opened many doors for her during her childhood, and that it “breaks my heart to see trans kids across the country lose out on these opportunities.”

Gaines, for his part, swam exceptionally well, leading Kentucky to a number of All-American and conference crowns.

While Biden’s proposal would make it more difficult for elementary schools to exclude a transgender girl, it would still allow them to do so for more competitive sports to prevent injury and maintain equality.

There is still a considerable review process ahead for the new rule.
