A move by the Texas Military Department to seize control of a municipal golf course situated at a significant Rio Grande border crossing has escalated tensions between federal and state authorities. Thursday, the Texas National Guard established barriers in Shelby Park, Eagle Pass, and issued a vacate order for U.S. Border Patrol agents in the vicinity.
The objective of this operation, which is being carried out in accordance with Operation Lone Star and Governor Greg Abbott’s emergency proclamation, is to restrict access to organizations that facilitate unauthorized border crossings and to prepare for potential surges in illegal immigration. However, Border Patrol agents, who are constrained by policies established in Washington, D.C. and are concerned with managing potential humanitarian crises, have expressed displeasure with the action.
In the vicinity of Shelby Park, the Texas National Guard apprehended a limited assemblage of migrants in close proximity to a border wall that was constructed in Texas. The consequences of the National Guard’s actions for migrants attempting to enter the park via the border remain unknown.
Breitbart Texas requested clarification from the Texas Military Department and the Office of the Texas Governor regarding the state’s legal authority to exclude federal agents from the park. Federal law grants Border Patrol agents the authority to enter any property, including private property.
The City of Eagle Pass issued a statement verifying that the Texas Department of Public Safety informed them of the park’s takeover and elaborating that the municipality had no bearing on the decision. A legal opinion has been sought by the municipality regarding the issue.
Recent confrontations between the frontier Patrol and Texas’s efforts to secure the frontier in this region have precipitated this development. In the past, Border Patrol agents breached razor-wire barriers that were erected by the state in order to permit access to the park for migrants who had traversed the river. Until the Department of Justice’s appeal to the U.S. Supreme Court, the Border Patrol is prohibited from severing the wire, which is the subject of an ongoing legal dispute.
