Erica Herman, a former girlfriend of Tiger Woods, allegedly attempted to go back on their silence last week. She did so by invoking the NDA’s provision allowing for its breach in the event of a disagreement over a sexual offense.
Herman and Woods agreed to keep their 2017 romance secret when they initially started dating. To finalize the couple’s divorce from last autumn, Herman just filed proceedings to have the arrangement found unlawful. “nondisclosure agreements or nondisparagement terms agreed to before a dispute involving sexual assault or sexual harassment in violation of federal, tribal, or state law are not judicially enforceable,” Herman said.
It has been reported that Herman filed a lawsuit against Woods after he evicted her from the residence they shared in Hobe Sound, Florida. Herman claims that she and Woods entered into a $30 million “oral tenancy agreement.” This arrangement said that Woods would compensate Herman for her continued use of the home.
Reports from TMZ claim that Woods referred to Herman as his “dumped ex-girlfriend” in court filings submitted on Monday.
Woods claims she has no legal standing to have the NDA thrown out since she has made no allegations of sexual misconduct in her court filings. According to Woods’ attorneys, Woods marked “NO” when asked whether or not there were allegations of sexual assault.
Woods claims in court documents, “Ms. Herman’s point of view is meaningless.” The legislation was enacted so that future incidents like this one would not cause as much suffering.
According to anonymous sources quoted in People magazine, “Tiger is outraged” by Herman’s allegations that he engaged in improper sexual behavior while they were dating.
Herman’s patience finally snapped when she arrived at the airport after Woods had reportedly urged her to “pack a suitcase for a brief vacation,” only to be told that she had been locked out of her residence. She claims that Woods covered her living expenses for a spell, but that he “scared her away” from the property afterward.
