It has been reported that former President Trump is not charged with retaining a classified Pentagon document containing plans to strike Iran as part of the 37-count indictment issued against him by Special Counsel Jack Smith. Smith’s indictment was brought as part of an investigation into whether Trump obstructed justice.
According to individuals who spoke with CBS News, the memo and an audio recording of an interview that took place in July 2021 at Trump’s club in Bedminster, New Jersey, are said to be described in Smith’s indictment. However, the former president did not face any charges regarding the presence of the note in his possession.
Trump’s claim that he did not have such papers and only had magazine and newspaper clippings appears to be called into question by the leaked and publicly released audio tape from 2021, which is central to the accusation.
The unsealed copy of the indictment obtained by Fox News indicates that Trump’s indictment, handed down earlier this month, includes 37 federal offenses. These charges include making false statements, intentionally retaining material that could compromise national security, and conspiring to obstruct the administration of justice.
