Habba’s comments came after Trump’s legal team filed an appeal with the Supreme Court, seeking to overturn a Colorado Supreme Court decision that removed him from the state’s ballot. The Colorado court’s ruling was based on the 14th Amendment’s clause on insurrection. Trump’s team argues that the issue of eligibility should be decided by Congress, not state courts, and maintains that Trump did not engage in insurrection.
Habba highlighted the conservative nature of Republicans, suggesting that they might shy away from appearing pro-Trump, even if the law supports their position. She urged the justices to focus on the law and the Constitution, emphasizing that there should be no politics in their decision.
The appeal filed by Trump’s lawyers contends that the Colorado ruling, if upheld, would be unprecedented in U.S. history, preventing voters from casting ballots for a major-party presidential candidate. They argue that the matter of eligibility is a congressional, not a judicial, decision.
